Terms of Service
1. Acceptance of Terms
By creating an account or using this animal rescue management system (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. The Service is provided through the Furball Rescue platform on behalf of the rescue organization (“Organization”) identified on the login page.
2. Description of Service
The Service is a web-based animal rescue management system used to track animals, manage foster placements, process adoptions, coordinate volunteers, and communicate with participants in the rescue’s operations. Access is provided to authorized staff, volunteers, foster parents, and other individuals as determined by the Organization.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must not share your account credentials with any other person.
- You must notify an administrator immediately if you suspect unauthorized access to your account.
- You must provide accurate and current information when creating your account.
4. Acceptable Use
You agree to use the Service only for purposes related to the Organization’s animal rescue operations. You agree not to:
- Access or attempt to access data you are not authorized to view
- Export, copy, or share personal information of adopters, fosters, reporters, or other individuals for any purpose unrelated to the Organization’s mission
- Use the email or SMS features to send unsolicited messages, spam, or marketing communications unrelated to the Organization’s operations
- Attempt to circumvent security controls, permissions, or access restrictions
- Upload malicious files, scripts, or content
- Use the Service in any manner that violates applicable law
5. Data Confidentiality
Information entered into the Service — including personal data of adopters, foster parents, volunteers, and reporters — is confidential. You agree to treat all such information with the same care you would treat your own confidential information. This obligation survives termination of your access to the Service.
6. Animal Welfare
All users of this Service commit to the humane treatment of animals. Any suspected abuse, neglect, or welfare concern must be reported to Organization leadership immediately. The Organization reserves the right to terminate access for any user found to have mistreated animals in their care.
7. Email and SMS Communications
The Service may send you transactional emails (confirmations, updates, password resets) and, if you opt in, SMS notifications related to your role. You may unsubscribe from non-essential emails using the link provided in each message. You may adjust SMS preferences in your account settings at any time.
8. Payments
Adoption fees and other payments are processed through Stripe, Inc. By making a payment through the Service, you agree to Stripe’s terms of service. The Organization sets all fee amounts and payment policies. Refund requests must be directed to the Organization.
9. Intellectual Property
The Service, including its software, design, and documentation, is provided by Furball Rescue and is protected by copyright and other intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property rights in the Service.
10. Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law:
- The Organization and Furball Rescue shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Total liability shall not exceed the amount you paid to use the Service in the 12 months preceding the claim (if any).
- Neither the Organization nor Furball Rescue is liable for decisions made based on data in the Service, including but not limited to adoption approvals, foster placements, or medical treatment decisions.
11. Termination
The Organization may suspend or terminate your access at any time, with or without cause. You may request account deactivation by contacting an administrator. Upon termination, your obligation to maintain data confidentiality continues.
12. Modifications
These Terms may be updated from time to time. When changes are made, you will be presented with the updated Terms and asked to accept them on your next login. Continued use of the Service after acceptance constitutes agreement to the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which the Organization is incorporated, without regard to conflict of law provisions.
